FAILURE TO CONDUCT A NEIGHBORHOOD IMPACT STUDY ON THE MADEIRA RIVER HYDROELECTRIC COMPLEX: A VIOLATION OF THE RIGHT TO THE CITY

Abstract

This article aims to analyze the concept of the right to the city and the promotion of sustainable urban spaces. It does so by examining the legal instrument of the Neighborhood Impact Study (EIV - Estudo de Impacto de Vizinhança), linking it to the facts arising from the implementation of the Madeira River hydroelectric complex. The objective is to verify whether the resulting construction projects properly applied these principles of urban space management. Thus, the research investigates the impacts experienced in the city and the (non-)compliance with existing regulations governing these concepts. Using a deductive method alongside comparative, monographic, and bibliographic procedures, the study connects these ideas and demonstrates that the carried-out projects did not seek the development of a balanced urban environment. This is evident from the alteration of pre-existing conditions and the inaction of state entities, due to the failure to conduct the necessary impact studies.
