CONFLICT FROM AN INTERCULTURAL PERSPECTIVE:

A DIALOGUE WITH THE INDIGENOUS JUSTICE SYSTEM

Abstract

The promotion of interculturality as a practice of interaction between sociocultural and legal systems has the potential, especially in the field of conflict treatment, to strengthen the processes of social pacification. The present work aims to analyze the intercultural dialogue, with regard to the indigenous and national justice system, in view of the ways of conflict resolution by consensual and dialogic means, aiming at the establishment of a culture of mutual respect and of equal consideration that different cultural expressions can bring. Through a methodology that privileges qualitative and explanatory research, adopting technical procedures based on bibliographic and documentary research, the work understands that the approximation between the aforementioned justice systems, from the intercultural perspective, favors the overcoming of colonialist paradigms of state law, increasing the effectiveness of social conflict resolution.
